Procedure for Providing Information on Supplementary Pensions to Eligible Persons
1. Death or Divorce – Need for Information
When a person dies, their next of kin often require information about the deceased, including financial information. Questions may also arise regarding the deceased's supplementary pension. For example, it may be necessary to determine whether the deceased still had outstanding claims against their employer or pension provider (insurance company or pension fund), or whether the surviving relatives are entitled to survivor's benefits.
A completely different situation concerns married persons who are in the process of divorcing and who require information about the assets of their spouse. These assets must be taken into account when dividing the matrimonial property. A supplementary pension may form part of those assets.
2. Right to Information – Respecting Privacy
In both situations, the persons concerned, their lawyers or, in some cases, notaries contact Sigedis. In order to assess such requests correctly and respond to them while respecting everyone's privacy, Sigedis requested an opinion from the Sectoral Committee for Social Security and Health, Social Security Section.
On 7 March 2017, the Committee confirmed that, in such situations, a right to information may exist (Decision No. 17/021). Following this decision, Sigedis developed a specific procedure. On 5 September 2017, the Sectoral Committee approved this procedure.
3. The Procedure
Subject to certain conditions, the surviving relatives of a deceased person and married persons involved in divorce proceedings may obtain information about the supplementary pension of the deceased or of their spouse, respectively.
